By using Florist Fuel you agree to these terms. They exist to protect both of us and to make sure the membership works the way it's supposed to. Please read them. They're written in plain English.
Who These Terms Apply To
These terms apply to anyone who visits floristfuel.com, books a discovery call, or becomes a paying member of Florist Fuel. Florist Fuel is operated by Justice Creative LLC, doing business as KindaWonderful, based in the United States.
By accessing our website or purchasing a membership, you agree to these terms. If you don't agree, please don't use the service.
The Membership
Florist Fuel is a subscription-based membership platform for independent retail florists. Depending on the tier you select, your membership may include access to AI content tools, monthly social kits, marketing education, a private member community, a co-branded sympathy catalog, professional photography, production recipes, buying formulas, wholesale access through AFloristFirst, and done-for-you digital marketing services.
The specific deliverables included in your membership are determined by the tier you purchase at the time of enrollment. We reserve the right to update, improve, or adjust membership deliverables over time. We will communicate material changes to active members in advance.
Geo-Exclusivity
Geo-exclusivity is available at the Tier 2 and Tier 3 levels. When a market is claimed, no other Florist Fuel member will be enrolled in that same territory for the same tier during your active membership.
Territory protection is tied to your active membership. If your membership lapses, is cancelled, or is terminated for any reason, your territory protection ends and the market may be made available to another florist.
Territory boundaries are determined by Florist Fuel at the time of enrollment and are communicated to you before your membership begins.
Billing and Payment
Memberships are billed on a recurring monthly basis. Your billing cycle begins on the date your membership is activated. Payments are processed automatically through Stripe using the payment method you provide at enrollment.
You are responsible for keeping your payment information current. If a payment fails, we will make reasonable attempts to notify you. Continued failure to resolve a failed payment may result in suspension or cancellation of your membership.
All fees are listed in US dollars. Pricing is subject to change. We will provide active members with at least 30 days notice before any pricing change takes effect.
Cancellation
You may cancel your membership at any time by contacting us at [email protected]. Cancellations take effect at the end of your current billing period. You will retain access to your membership through the end of the period you have already paid for.
We do not offer prorated refunds for partial months. If you cancel mid-cycle, your access continues through the end of that billing period and does not renew.
Refunds
We do not offer refunds on monthly membership fees once a billing cycle has been processed. If you believe a charge was made in error, contact us within 7 days of the charge and we will review it.
Printed catalog orders and physical goods are non-refundable once production has begun. If there is a defect or fulfillment error on our end, we will make it right.
Content and Intellectual Property
All content provided through Florist Fuel, including photography, recipes, templates, copy, and educational materials, is licensed to you for use in your own shop's marketing and operations. It is not transferable and may not be resold, sublicensed, or shared with other florists or businesses outside your shop.
Content developed by Kuhn Flowers and provided through the Florist Fuel membership remains the intellectual property of its respective creators. Your membership grants you a limited, non-exclusive license to use that content for the purposes described in your tier.
Florist Fuel, the Florist Fuel logo, and related marks are trademarks of Justice Creative LLC. You may not use them without written permission.
Image Licensing (Tier 2 and Tier 3 Members)
Professional arrangement photography provided through Tier 2 and Tier 3 memberships is licensed to you, not owned by you. Your license to use these images is active only while your membership remains current and in good standing.
This license permits you to use the provided images on your website, in your sympathy catalog, on social media, and in other marketing materials for your shop. You may not sell, transfer, or sublicense the images to any other party.
If your membership is cancelled, lapses, or is terminated for any reason, your license to use the Florist Fuel photography ends on the same date your membership ends. You are responsible for removing licensed images from your website, printed materials, and any other active marketing channels at that time. Continued use of the images after your membership ends is a violation of these terms.
The AI GPT Tool
Access to the Florist Fuel custom GPT tool is included as part of your membership. The tool is powered by third-party AI technology. While we have built and tested this tool specifically for florists, we cannot guarantee specific outcomes from its use. Results will vary based on how the tool is used, your market, and other factors outside our control.
You are responsible for reviewing any content generated by the tool before publishing or distributing it. We are not liable for errors, inaccuracies, or outcomes resulting from AI-generated content.
Third-Party Services
Florist Fuel integrates with or recommends third-party platforms including GoHighLevel, Stripe, and AFloristFirst. Your use of those platforms is governed by their own terms and policies. We are not responsible for changes to third-party services, pricing, availability, or performance.
Limitation of Liability
Florist Fuel and Justice Creative LLC are not liable for any indirect, incidental, or consequential damages arising from your use of the membership, the content provided, or any tools or services connected to the platform.
Our total liability to you for any claim related to your membership will not exceed the total amount you paid in the 30 days prior to the claim.
No Guarantee of Results
We are honest about what Florist Fuel is and what it can do. We do not guarantee specific business outcomes, revenue increases, lead volume, or search ranking improvements. Results depend on many factors, including how consistently you use the tools and how your local market responds. What we can guarantee is that we will show up, deliver what we promise, and work to make the membership genuinely useful.
Termination
We reserve the right to suspend or terminate a membership if a member violates these terms, misuses the platform or its content, or engages in conduct that is harmful to other members or to Florist Fuel. In the event of termination for cause, no refund will be issued for the current billing period.
Changes to These Terms
We may update these terms from time to time. If we make material changes, we will update the date at the top of this page and notify active members directly. Continued use of your membership after changes take effect constitutes acceptance of the updated terms.
Governing Law
These terms are governed by the laws of the State of Florida, United States. Any disputes arising from your membership will be handled in the appropriate courts of that jurisdiction.
